Arbitration

Arbitrators act as private judges and are licensed to decide issues as a matter of law. Arbitration spares the court expenses of a trial and a jury, but many of the procedures are the same. Issues related to evidence, findings of fact, and examining witnesses are all decided by the arbitrator who renders a binding decision that both parties must abide by. Mediation

Whereas arbitration is a binding decision made by a private judge, mediation is a negotiation between two parties in a dispute. The main difference is that mediation is non-binding. The mediator helps both sides reach an agreement that puts the dispute to bed. However, if neither side is happy with the arrangement, they do not forgo their right to have the case heard by a jury. Alternatively, they can still move the case to arbitration. Mediation is a cost-effect means of resolving business disputes.
